Terms and Conditions

Please read these terms and conditions carefully before using our services. By engaging our services, you agree to be bound by these terms.

1. Service Agreement

By booking our services, you enter into a contract with ShiftMax Logistics. These terms govern the provision of packing, moving, and related services. This agreement becomes effective upon confirmation of your booking and payment of the required advance amount.

Our services include but are not limited to: residential and commercial moving, packing and unpacking, loading and unloading, transportation, storage solutions, and related logistics services. The scope of work will be clearly defined in your service quotation and booking confirmation.

Any modifications to the original agreement must be made in writing and agreed upon by both parties. Verbal agreements or promises made outside of this written contract are not binding unless documented in writing.

2. Booking and Payment

Our booking and payment process is designed to ensure transparency and security for all parties involved:

  • All bookings must be confirmed with advance payment as specified in the quotation (typically 25-50% of total cost)
  • Payment terms are net 30 days unless otherwise specified in your service agreement
  • We accept payments via cash, bank transfer, UPI, credit/debit cards, and digital wallets
  • Additional charges may apply for services not included in the original quote, such as extra packing materials, additional labor, or extended storage
  • Cancellation charges may apply as per our cancellation policy: 48+ hours notice (10% charge), 24-48 hours (25% charge), less than 24 hours (50% charge)
  • Full payment is due upon completion of services unless prior credit arrangements have been made
  • Late payment charges of 2% per month may apply on overdue amounts
  • All prices are subject to applicable taxes and government levies

3. Customer Responsibilities

To ensure a smooth and successful moving experience, customers are required to fulfill the following responsibilities:

  • Provide accurate and complete inventory list including all items to be moved, their approximate value, and any special handling requirements
  • Ensure all items are properly prepared for moving, including emptying drawers, defrosting refrigerators, and securing loose parts
  • Declare valuable and fragile items in advance with their estimated value for appropriate insurance coverage
  • Provide clear access to both pickup and delivery locations, including parking arrangements and elevator reservations if required
  • Be present or authorize a responsible representative (18+ years) during pickup and delivery to sign necessary documents
  • Provide accurate contact information and notify us immediately of any changes to addresses, phone numbers, or moving dates
  • Obtain necessary permits and documentation for the move, including building permissions and interstate transport documents
  • Remove or properly dispose of hazardous materials before our team arrives
  • Ensure all personal and important documents are carried separately and not packed with household goods
  • Provide clear instructions for item placement at the destination

4. Liability and Insurance

We take the safety of your belongings seriously and provide comprehensive protection options:

  • We provide basic coverage as per industry standards (₹10 per kg for household goods and ₹100 per kg for electronic items)
  • Additional comprehensive insurance can be purchased for high-value items at 1-3% of declared value
  • All claims must be reported within 24 hours of delivery with photographic evidence and detailed description
  • We are not liable for items packed by the customer or items not declared in the inventory list
  • Perishable items, plants, hazardous materials, and items of extraordinary value are moved at customer's risk
  • Our liability is limited to the declared value of items or actual replacement cost, whichever is lower
  • We are not responsible for delays caused by weather conditions, natural disasters, or government restrictions
  • Items left in storage beyond the agreed period are subject to additional charges and limited liability
  • Claims settlement will be processed within 30 days of receiving complete documentation
  • We maintain comprehensive general liability and vehicle insurance for all our operations

5. Prohibited Items

For safety and legal reasons, we do not transport the following items:

  • Hazardous materials including explosives, flammable liquids, gases, corrosive substances, and toxic materials
  • Perishable food items, frozen foods, and live plants (except with special arrangements)
  • Important documents such as passports, birth certificates, insurance papers, and legal documents (carry personally)
  • Cash, jewelry, precious metals, stones, and other high-value items (unless properly declared and insured)
  • Illegal items, contraband, or items prohibited by law
  • Firearms, ammunition, and weapons (unless proper licenses are provided)
  • Prescription medications and medical equipment requiring special handling
  • Items with sentimental value that cannot be replaced (family heirlooms, photographs, etc.)
  • Pets and live animals (we can arrange specialized pet relocation services separately)
  • Items that may cause damage to other goods or our equipment
  • Opened bottles of liquids, paints, and chemicals

If any prohibited items are discovered during packing or loading, we reserve the right to refuse transport and may charge additional fees for delays caused.

6. Delivery and Storage

Our delivery and storage policies are designed to provide flexibility while ensuring the safety of your belongings:

  • Delivery dates provided are estimates based on distance, route conditions, and normal circumstances
  • We will make every effort to deliver within the promised timeframe, but delays may occur due to weather, traffic, vehicle breakdown, or other unforeseen circumstances
  • Customers will be notified 24 hours in advance of the expected delivery time
  • Storage charges apply if delivery is delayed due to customer unavailability, incomplete address, or access issues (₹50-100 per day depending on volume)
  • Items in storage are kept in our secure, climate-controlled warehouses with 24/7 security monitoring
  • Storage is provided free for the first 7 days, after which daily charges apply
  • Items in storage are subject to our warehouse terms and conditions and limited liability coverage
  • Customers must provide 48 hours notice for delivery from storage
  • Long-term storage arrangements can be made with separate agreements and pricing
  • We reserve the right to dispose of unclaimed items after 90 days with proper legal notice

7. Force Majeure

We are not liable for delays, damages, or inability to perform services caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters such as earthquakes, floods, cyclones, or severe weather conditions
  • Government actions, regulations, or restrictions including lockdowns and curfews
  • Labor strikes, bandhs, or civil unrest
  • War, terrorism, or acts of violence
  • Pandemic or epidemic situations and related restrictions
  • Road closures, bridge collapses, or infrastructure failures
  • Vehicle breakdowns or accidents beyond normal wear and tear
  • Power outages affecting our operations or customer locations

In such cases, we will make reasonable efforts to minimize delays and keep customers informed. Any additional costs incurred due to force majeure events may be passed on to the customer.

8. Dispute Resolution

We are committed to resolving any disputes fairly and efficiently:

  • All disputes should first be reported to our customer service team for immediate resolution
  • If not resolved within 7 days, the matter will be escalated to our management team
  • Unresolved disputes shall be settled through arbitration in accordance with the Arbitration and Conciliation Act, 2015
  • The arbitration shall be conducted by a single arbitrator mutually agreed upon by both parties
  • The seat of arbitration shall be at our registered office location
  • The language of arbitration proceedings shall be English or Hindi as mutually agreed
  • The jurisdiction for legal matters shall be the courts of our registered office location
  • Both parties agree to bear their own costs unless the arbitrator decides otherwise
  • The arbitrator's decision shall be final and binding on both parties

9. Privacy Policy

We are committed to protecting your privacy and personal information:

  • We collect only necessary information required for service delivery including name, address, contact details, and inventory information
  • Your personal information is handled in accordance with applicable data protection laws and regulations
  • Information is used solely for service delivery, communication, billing, and improving our services
  • We do not sell, rent, or share your personal information with third parties without your consent
  • Your data is stored securely and access is limited to authorized personnel only
  • We may share information with our service partners (packers, transporters, insurance providers) only as necessary for service delivery
  • You have the right to access, update, or request deletion of your personal information
  • We retain your information only as long as necessary for business and legal purposes
  • Any data breaches will be reported to you and relevant authorities as required by law

10. Modifications and General Terms

These terms and conditions may be updated from time to time to reflect changes in our services or legal requirements:

  • We reserve the right to modify these terms and conditions at any time with reasonable notice
  • Updated terms will be posted on our website and will apply to future bookings
  • Existing bookings will continue to be governed by the terms in effect at the time of booking
  • Customers will be notified of significant changes via email or SMS
  • Continued use of our services after modifications constitutes acceptance of the updated terms
  • If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force
  • These terms constitute the entire agreement between the parties and supersede all prior agreements
  • No waiver of any term shall be deemed a waiver of any other term or future breach
  • Headings are for convenience only and do not affect the interpretation of these terms
  • These terms are governed by Indian law and subject to Indian jurisdiction
